Terms and Conditions

Effective from 21 July 2022

1. About these terms

These Terms and Conditions apply to your use of the Christian Surfers New Zealand website and to purchases made through our online shop, including merchandise, books, event tickets, camp registrations and other products or services.

In these terms, "Christian Surfers New Zealand", "CSNZ", "we", "us" and "our" refer to:

By using our website, placing an order or registering for an event, you agree to these Terms and Conditions.

Specific events, camps or programmes may have additional registration conditions, safety requirements or cancellation terms. These will be provided on the relevant event page or registration form and form part of these Terms and Conditions.

Nothing in these terms limits any rights you may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or any other New Zealand law that cannot legally be excluded.

2. Eligibility and authority

You must provide accurate and complete information when placing an order or registering for an event.

If a participant is under 18 years old, their registration must be completed or approved by their parent or legal guardian. The parent or guardian confirms that they have authority to provide consent and relevant information on the participant's behalf.

If you make a purchase or registration for another person, you confirm that you have their permission to provide their information and agree to the applicable terms on their behalf.

3. Orders and registrations

Submitting an order or registration does not automatically guarantee acceptance.

Your order or registration is confirmed when:

  • we receive the required payment;
  • you receive confirmation from us; and
  • any required registration, medical, consent or participant information has been completed.
We may decline or cancel an order or registration if:

  • a product is unavailable;
  • an event has reached capacity;
  • incorrect information or pricing has been displayed;
  • payment cannot be processed;
  • the person does not meet the stated eligibility requirements; or
  • accepting the registration would create a safety or operational concern.
If we cancel an order before supplying the product or service, we will refund the amount paid unless you agree to another suitable option.

4. Prices and payment

All prices are stated in New Zealand dollars and include GST where applicable.

Any delivery charges, booking fees or other additional costs will be shown before you complete your purchase.

Promotional prices, discount codes and early-bird offers:

  • are available only for the stated period;
  • may be limited by availability;
  • cannot normally be applied retrospectively; and
  • cannot be exchanged for cash.
Payments are processed using the payment method or third-party payment provider shown at checkout. We do not directly store complete credit or debit card details.

You are responsible for providing accurate billing and contact information.

5. Merchandise availability

All merchandise orders are subject to availability.

We aim to ensure product descriptions, photographs, colours, sizing and prices are accurate. However, colours and appearance may vary slightly depending on your device, and minor differences may occur between product batches.

If a product becomes unavailable after you order it, we will contact you and offer an appropriate replacement, store credit or refund.

6. Shipping and delivery

We currently deliver merchandise to New Zealand addresses unless otherwise stated or agreed with us.

Any shipping cost or free-shipping offer will be displayed on the product page or during checkout.

We aim to dispatch orders promptly. Delivery times are estimates and can be affected by couriers, public holidays, weather, remote locations and other circumstances outside our reasonable control.

Please ensure your delivery address is correct. Contact us as soon as possible if you notice an error. We cannot guarantee that an address can be changed after an order has been dispatched.

If an order has not arrived within a reasonable time, please contact us so we can investigate.

7. Returns, exchanges and faulty products

Change of mind

We are not required to provide a refund where you simply change your mind or choose the wrong item or size.

However, we may offer an exchange or store credit at our discretion where:

  • you contact us within 14 days of receiving the item;
  • the item has not been worn, washed, used or damaged;
  • all original tags and packaging remain attached; and
  • you provide proof of purchase.
Unless the item is faulty or was supplied incorrectly, you are responsible for the cost of returning it and for any cost involved in sending a replacement.

Some items may not be eligible for a change-of-mind exchange for hygiene, safety or customisation reasons.

Faulty, damaged or incorrect products

If a product is faulty, damaged, does not match its description or was supplied incorrectly, please contact us with your order details and photographs where possible.

We will meet our obligations under the Consumer Guarantees Act 1993, which may include repairing or replacing the product or providing a refund.

These rights are in addition to any voluntary exchange policy we offer.

8. Event and camp registrations

Event registration fees cover the items and services described on the relevant event page. Depending on the event, this may include accommodation, meals, activities, venue costs, programme resources or other event expenses.

Transport to and from an event is not included unless specifically stated.

Participants may be required to provide:

  • emergency contact information;
  • relevant medical, allergy or dietary information;
  • consent from a parent or guardian;
  • acknowledgement of event rules or safety information; and
  • any additional information reasonably needed to run the event safely.
You must advise us of any relevant change to the information provided before the event begins.

Providing incomplete or inaccurate information may affect our ability to safely accommodate the participant.

9. Participant cancellations

Any cancellation and refund policy displayed on the relevant event page, ticket description or registration form will apply to that event.

Where no specific cancellation policy is displayed, please contact us as soon as possible if you can no longer attend.

Any refund may take into account reasonable and non-recoverable costs that CSNZ has already committed based on your registration, such as accommodation, catering, venue or booking costs.

A registration may be transferred to another eligible person only with our prior approval and after the replacement participant has completed all required registration and consent information.

Not attending an event without notifying us does not automatically entitle you to a refund.

Nothing in this section limits any rights or remedies available under New Zealand law.

10. Event changes or cancellation by CSNZ

Christian Surfers events may be affected by weather, surf conditions, venue availability, public-health requirements, transport disruption, staffing, safety concerns or other circumstances outside our reasonable control.

We may make reasonable changes to:

  • the event programme;
  • speakers or leaders;
  • surf locations;
  • activities;
  • accommodation;
  • meal arrangements; or
  • event times.
A change to a speaker, activity, surf location or programme does not automatically entitle a participant to a refund where the overall event can still be reasonably delivered.

If we cancel an event and do not provide a suitable alternative, we will refund the event fee paid.

If an event is postponed or materially changed, we will contact registered participants and provide reasonable options based on the circumstances. These may include transferring the registration, receiving credit or receiving a refund.

Unless required by law, CSNZ is not responsible for separate travel, accommodation or other costs booked independently by a participant.

11. Safety, conduct and participation

Surfing, swimming, outdoor activities, travel and adventure activities involve inherent risks. We take reasonable steps to manage safety, but not every risk can be removed.

Participants must:

  • follow reasonable instructions from CSNZ staff, leaders and activity providers;
  • act respectfully toward other participants, staff, volunteers and members of the public;
  • use appropriate safety equipment;
  • disclose relevant health or safety information;
  • avoid behaviour that places themselves or others at unreasonable risk; and
  • comply with event rules, venue requirements and New Zealand law.
Activities may be changed, restricted or cancelled where conditions are considered unsafe.

We may remove a person from an event or activity where their behaviour is seriously unsafe, threatening, discriminatory, abusive, unlawful or disruptive. Where removal results from a serious breach of these terms, a refund may not be provided except where required by law.

Separate waivers, consent forms or codes of conduct may apply to particular activities or events.

12. Donations

Donations made to CSNZ are voluntary and are separate from purchases of goods, tickets or services.

Donations are generally non-refundable once received. Please contact us promptly if:

  • a donation was made by mistake;
  • an incorrect amount was entered;
  • a payment was duplicated; or
  • a payment was made without authorisation.
We will assess the circumstances and meet any obligations required by law.

Eligibility for a donation tax credit depends on the donor's circumstances and current Inland Revenue requirements. Donors should retain their donation receipt and seek independent tax advice where needed.

13. Website use

You may use our website for lawful, personal and non-commercial purposes.

You must not:

  • attempt to interfere with the website's security or operation;
  • introduce malware or harmful code;
  • access another person's account without permission;
  • copy or commercially exploit website content without permission;
  • submit false, unlawful, abusive or misleading information; or
  • use the website in a way that infringes another person's rights.
We may restrict access to the website or an account where we reasonably believe these terms have been breached.

14. Intellectual property

Unless otherwise stated, the content on this website—including text, photographs, graphics, video, logos and design elements—is owned by or licensed to Christian Surfers New Zealand.

You may view and share links to our public website content for personal and non-commercial purposes.

You must not reproduce, sell, modify, publish or commercially use our content or branding without prior written permission.

Christian Surfers and associated names and logos may also be owned or licensed through Christian Surfers International or another Christian Surfers organisation.

15. Third-party websites and services

Our website may contain links to third-party websites or services, including registration tools, payment providers, social-media platforms and external resources.

These services are operated independently and may have their own terms and privacy policies. We are not responsible for third-party content, availability or practices, except to the extent required by law.

A link does not necessarily mean that we endorse every statement, product or service on that website.

16. Privacy

We collect and use personal information to:

  • process purchases and payments;
  • deliver orders;
  • administer events, programmes and registrations;
  • manage safety and emergency information;
  • respond to enquiries, feedback and complaints;
  • issue receipts and confirmations; and
  • communicate with you where you have requested or agreed to receive communications.
We handle personal information in accordance with the Privacy Act 2020 and our Privacy Policy.

You may ask to access or correct personal information that we hold about you by contacting us.

Marketing messages will include a way to unsubscribe. Unsubscribing from marketing does not prevent us from sending messages necessary to manage an order, donation or event registration.

17. Website information and availability

We aim to keep website information accurate and current, but errors or temporary interruptions may occur.

We may update, suspend or remove website content, products or functionality at any time.

To the extent permitted by law, we are not responsible for loss arising solely from reliance on general website information where professional or specialised advice should reasonably have been obtained.

18. Liability

Nothing in these terms excludes, restricts or modifies any liability or consumer right that cannot legally be excluded.

To the extent permitted by law, CSNZ will not be liable for indirect or consequential loss that was not reasonably foreseeable when the product, service or registration was purchased.

Our liability will not be limited where loss or damage results from conduct for which liability cannot lawfully be excluded or restricted.

Participants remain responsible for their personal belongings, except where loss or damage is caused by CSNZ and we are legally responsible.

19. Concerns and complaints

Please contact us first if you have a concern about a purchase, registration, event or service. We will try to respond fairly and resolve the matter directly.

Safety concerns, feedback and formal complaints can also be submitted through the Safety and Complaints section of our website.

Nothing in these terms prevents you from seeking assistance from Consumer Protection, the Commerce Commission, the Disputes Tribunal or another appropriate organisation.

20. Changes to these terms

We may update these Terms and Conditions from time to time.

The updated version will be published on our website with a revised effective date. Changes will not retrospectively remove rights that have already arisen under an existing purchase or registration.

21. New Zealand law

These Terms and Conditions are governed by New Zealand law.

Any dispute will be subject to the jurisdiction of the New Zealand courts and tribunals, while recognising any rights a consumer may have to bring a claim in another appropriate jurisdiction.

If any part of these terms is found to be invalid or unenforceable, the remaining sections will continue to apply.
